PT Member & Studio Member Terms of Service

1. Introduction

Welcome to PTAsistant.

These Terms of Service ("Terms") govern the legal relationship between you ("PT Member", "Studio Member", or "User") and DarkLag Software when using the PTAsistant mobile application, Apple Watch application, and related digital services.

By creating or using a PTAsistant account, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.

If you do not agree with these Terms, you must not use PTAsistant.

2. Service Provider

This service is developed and operated by DarkLag Software.

3. Purpose of the Service

PTAsistant is a professional digital sports management platform designed to provide secure communication and collaboration between personal trainers, sports studios, and their members.

The platform may provide the following services:

• Viewing workout programs.
• Viewing nutrition plans.
• Body measurement tracking.
• Body progress analysis.
• Apple Health integration.
• Apple Watch integration.
• AI-powered meal analysis.
• Appointment management.
• Group classes.
• Sport-specific experiences.
• Performance tracking.
• Notification services.
• Progress reports.

DarkLag Software reserves the right to improve, update, modify, or discontinue certain features of the Services at any time.

4. Eligibility

These Terms apply exclusively to the following user categories:

• PT Members.
• Studio Members.

Both user types refer to clients who have been invited to or registered within the PTAsistant platform by a Personal Trainer or a Sports Studio.

5. Account Creation

Your PT Member or Studio Member account may be created by your Personal Trainer or Sports Studio, or provided to you through an invitation system.

To activate your account, you must provide accurate, current, and complete information whenever requested.

Providing false or misleading information may result in temporary or permanent restrictions on your account.

6. Membership Structure

PT Member and Studio Member accounts do not operate under an individual subscription model.

Your account is provided through the active PTAsistant subscription of the Personal Trainer or Sports Studio with whom you are affiliated.

Accordingly:

• You are not required to purchase an individual subscription.
• You are not charged a separate membership fee for using the application.
• Your access to PTAsistant is provided through the active subscription maintained by your Personal Trainer or Sports Studio.

If the subscription of your Personal Trainer or Sports Studio expires, is suspended, or is terminated, access to certain features or services may be restricted or discontinued.

7. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

You must not share your password or authentication information with any third party.

If you suspect unauthorized access to your account, you should notify your Personal Trainer, Sports Studio, or DarkLag Software as soon as reasonably possible.

8. Acceptable Use

PTAsistant must be used solely for managing your personal fitness and performance journey.

By using the Services, you agree to comply with:

• Applicable laws and regulations.
• These Terms of Service.
• Community guidelines.
• Applicable data protection and privacy laws.

Any use of the Services outside their intended purpose is prohibited.

9. User Responsibilities

As a PT Member or Studio Member, you agree that you will:

• Maintain accurate account information.
• Keep your account for your own personal use only.
• Use the Services lawfully.
• Follow workout and nutrition plans at your own discretion and responsibility.
• Not engage in activities that compromise platform security.
• Respect the rights and privacy of other users.

10. Relationship with Your Personal Trainer or Sports Studio

PTAsistant functions solely as a digital platform.

The services provided by your Personal Trainer or Sports Studio—including pricing, coaching methods, scheduling, and professional decisions—are solely the responsibility of the respective trainer or studio.

DarkLag Software is not a party to the professional relationship established between you and your Personal Trainer or Sports Studio.

11. Account Suspension or Termination

DarkLag Software reserves the right to temporarily suspend or permanently terminate your account if you:

• Violate these Terms of Service.
• Violate the Privacy Policy.
• Infringe upon the rights of other users.
• Compromise the security of the platform.
• Provide false or misleading information.
• Engage in unlawful activities.
• Use the Services for unauthorized purposes.
• Attempt unauthorized access to the platform or other user accounts.

Where appropriate, your Personal Trainer or Sports Studio may also suspend or terminate your access within their own organization.

Such actions do not affect any additional legal rights or remedies available to DarkLag Software.

12. Apple Health and Apple Watch

PTAsistant supports integration with Apple Health and Apple Watch as part of its professional fitness and performance management platform.

Apple Health integration is entirely optional.

Your Apple Health data will only be accessed with your explicit permission.

Neither PTAsistant nor your Personal Trainer may access any health information that you have not authorized.

Authorized Apple Health information may be used solely for purposes such as:

• Evaluating workout performance.
• Monitoring daily activity.
• Analyzing recovery.
• Tracking cardiovascular performance.
• Creating personalized workout programs.
• Preparing progress reports.

You may revoke Apple Health access at any time through your device settings.

Once access is revoked, PTAsistant will no longer retrieve new Apple Health data.

13. AI Services

PTAsistant includes features powered by artificial intelligence.

AI may be used for:

• Meal analysis.
• Nutrition recommendations.
• Calorie estimation.
• Macronutrient estimation.
• Daily nutrition evaluation.
• Performance analysis.
• Sport-specific recommendations.
• Progress reporting.

All AI-generated outputs are provided solely for informational and supportive purposes.

They are not intended to replace professional medical advice, diagnosis, or treatment.

14. AI Meal Analysis

When you use the AI Meal Analysis feature, uploaded meal photos may be analyzed using artificial intelligence.

The analysis may generate estimated information including:

• Estimated calories.
• Protein.
• Carbohydrates.
• Fat.
• Dietary fiber.
• Meal quality assessment.
• Daily nutrition goal compliance.

These results are provided solely for informational purposes.

Actual nutritional values may differ depending on ingredients, preparation methods, and portion sizes.

15. Sharing AI Meal Analysis with Your Personal Trainer

The primary purpose of PTAsistant is to facilitate communication and progress tracking between Personal Trainers and their clients.

Accordingly, when you use the AI Meal Analysis feature, the generated analysis results may be viewed by the Personal Trainer who invited you to the platform and is currently responsible for your coaching.

This sharing supports:

• Evaluating adherence to nutrition plans.
• Monitoring daily calorie intake.
• Reviewing macronutrient balance.
• Updating nutrition programs when appropriate.
• Tracking performance goals.
• Supporting healthy progress.
• Providing more personalized feedback.

The sharing of AI Meal Analysis results with your assigned Personal Trainer is an essential component of this feature.

By using AI Meal Analysis, you acknowledge and agree that these results may be shared with your assigned Personal Trainer for the purposes described above.

16. Health Data and Body Measurements

PTAsistant may support tracking various health and performance metrics, including:

• Height.
• Weight.
• Body fat percentage.
• Muscle mass.
• Body Mass Index (BMI).
• Body measurements.
• Sport-specific performance metrics.
• Apple Health data.
• Apple Watch workout records.
• Progress photos.

These records are processed solely to monitor your personal development and enable your assigned Personal Trainer to prepare more accurate and personalized programs.

17. Progress Photos

PTAsistant allows you to upload progress photos to visually monitor your development.

These photos are accessible only to:

• You.
• Your assigned Personal Trainer.
• Authorized trainers within your Sports Studio who are responsible for your coaching.

Progress photos are never used for advertising, marketing, or commercial purposes.

18. User Content

You retain ownership of all content that you create or upload through PTAsistant.

This content may include:

• Personal notes.
• Progress records.
• Body measurements.
• Meal photos.
• Workout records.

DarkLag Software does not claim ownership of your content.

However, you grant DarkLag Software the limited technical rights necessary to process, store, display, and share such content solely with your assigned Personal Trainer as required to provide the Services.

19. Prohibited Uses

You may not use PTAsistant to:

• Engage in unlawful activities.
• Access or use another person's account.
• Attempt to compromise account or platform security.
• Upload malicious software or harmful code.
• Disrupt or interfere with the normal operation of the platform.
• Harass, threaten, or abuse other users.
• Publish misleading health or nutrition information.
• Upload content that infringes intellectual property rights.
• Use the Services for purposes other than their intended use.

DarkLag Software reserves the right to suspend or permanently terminate accounts involved in such activities without prior notice.

20. Medical Disclaimer

PTAsistant is not a healthcare provider.

The platform does not replace:

• Physicians.
• Dietitians.
• Physiotherapists.
• Psychologists.
• Other qualified healthcare professionals.

Workout programs, nutrition plans, Apple Health information, Apple Watch records, AI analyses, and all other performance-related insights provided within PTAsistant are intended solely for informational and supportive purposes.

If you have a medical condition, illness, injury, or require medical advice, diagnosis, or treatment, you should consult an appropriately qualified healthcare professional.

21. Service Updates

DarkLag Software continuously works to improve PTAsistant.

Accordingly, we may:

• Introduce new features.
• Improve existing functionality.
• Enhance the user experience.
• Discontinue certain services.
• Update the application interface.

Where appropriate, significant updates may be communicated through the application or your registered contact information.

22. Service Availability

DarkLag Software aims to provide PTAsistant with the highest reasonably achievable level of availability.

However, temporary interruptions may occur due to:

• Scheduled maintenance.
• Security updates.
• Infrastructure improvements.
• Third-party service outages.
• Internet connectivity issues.
• Technical failures.
• Force majeure events.

Whenever reasonably possible, planned maintenance will be announced in advance.

23. Scope of the Services

The features available to PT Members and Studio Members may vary depending on the subscription plan maintained by your Personal Trainer or Sports Studio.

DarkLag Software reserves the right to:

• Add new features.
• Remove existing features.
• Modify usage limits.
• Introduce additional services.
• Enhance current functionality.

Certain features may only be available if they are included within your Personal Trainer's or Sports Studio's active subscription plan.

24. End of Your Relationship with a Personal Trainer or Sports Studio

If your professional relationship with your Personal Trainer or Sports Studio ends, your access to certain PTAsistant features may change.

For example:

• You may no longer receive new workout programs.
• New nutrition plans may no longer be created for you.
• Appointment scheduling may become unavailable.
• Access to certain advanced features may be restricted.

Your personal progress records will continue to be retained in accordance with the data retention provisions described in the PTAsistant Privacy Policy.

25. Limitation of Liability

PTAsistant is a digital software platform designed to support personal fitness management.

DarkLag Software shall not be liable for any direct or indirect damages arising from or relating to:

• Professional services provided by your Personal Trainer.
• Services provided by your Sports Studio.
• Workout programs prepared by trainers.
• Nutrition plans created by trainers.
• Activities performed outside the PTAsistant platform.
• The accuracy of Apple Health data.
• Services provided by third-party providers.

AI-generated analyses, performance evaluations, and recommendations available within PTAsistant are intended solely as supportive information.

26. User Responsibilities

As a PT Member or Studio Member, you agree that you will:

• Use your account only for your own personal use.
• Provide accurate and up-to-date information.
• Use PTAsistant in compliance with all applicable laws and regulations.
• Respect the rights and privacy of other users.
• Follow workout and nutrition programs while taking your own health condition into consideration.
• Not misuse the Services or engage in activities that compromise platform security.

You are solely responsible for all activities performed through your account.

27. Force Majeure

DarkLag Software shall not be liable for any delay, interruption, or failure to provide the Services resulting from events beyond its reasonable control, including but not limited to:

• Natural disasters.
• War.
• Terrorist attacks.
• Pandemics or epidemics.
• Large-scale power or internet outages.
• Government actions or regulations.
• Cybersecurity incidents.
• Other force majeure events.

In such circumstances, reasonable efforts will be made to restore the Services as soon as practicable.

28. Account Suspension or Termination

DarkLag Software reserves the right to temporarily suspend or permanently terminate your account if you:

• Violate these Terms of Service.
• Violate the Privacy Policy.
• Infringe upon the rights of other users.
• Provide false or misleading information.
• Attempt unauthorized access.
• Compromise the security of the platform.
• Use the Services for unauthorized purposes.
• Engage in unlawful activities.

Your affiliated Personal Trainer or Sports Studio may also terminate your membership within its own organization.

In such cases, DarkLag Software may continue to administer your account from a technical perspective; however, it is not a party to the professional relationship between you and your Personal Trainer or Sports Studio.

29. Changes to These Terms

DarkLag Software may update these Terms of Service from time to time.

Material changes may be communicated through the application or your registered contact information.

The most current version published within PTAsistant shall always govern your use of the Services.

Your continued use of PTAsistant after such updates constitutes your acceptance of the revised Terms.

30. Governing Law

These Terms of Service shall be interpreted and enforced in accordance with applicable laws, including relevant consumer protection and data protection legislation.

The parties agree to make reasonable efforts to resolve disputes through good-faith negotiations before pursuing formal legal proceedings.

Nothing in these Terms limits any mandatory legal rights available under applicable law.

31. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced only to the maximum extent permitted by law.

All remaining provisions shall continue in full force and effect.

32. No Waiver

The failure or delay of DarkLag Software to exercise any right or remedy under these Terms shall not constitute a waiver of that right or any other right.

4. Eligibility

To use PTAsistant, you must:

• Have the legal capacity to enter into this Agreement under applicable law.
• Create your account using accurate and truthful information.
• Comply with these Terms of Service.

Identity verification or business verification may be requested where necessary.

5. Account Registration

You must provide accurate, current, and complete information when creating your PT account.

Providing false or misleading information may result in:

• Temporary suspension of your account.

• Permanent termination of your account.

You are solely responsible for all activities performed through your account.

6. Account Security

You are responsible for maintaining the confidentiality and security of your login credentials.

You must not share your password or authentication information with third parties.

If you become aware of unauthorized access to your account, you should contact DarkLag Software as soon as possible.

DarkLag Software is not responsible for unauthorized access resulting from your negligence.

7. Membership Types

PTAsistant may offer several account types, including:

• Personal Trainer.
• Studio Trainer.
• Studio Owner.
• PT Member.
• Studio Member.
• Individual Member.

These Terms of Service apply exclusively to Personal Trainer and Studio Trainer accounts.

8. Subscription Services

Certain PTAsistant features may require a paid subscription.

Subscription plans may be updated from time to time.

Subscription benefits may vary depending on:

• Client capacity.
• AI usage limits.
• Storage capacity.
• Advanced reporting tools.
• Studio management features.
• Additional professional tools.

Subscription pricing and available features are clearly displayed before purchase.

9. Automatic Renewal

Unless otherwise stated, paid subscriptions may automatically renew at the end of the selected billing period.

You may disable automatic renewal at any time through your App Store subscription settings.

All subscription billing and payment processing are managed by Apple.

10. Use of the Services

PTAsistant must be used only for lawful, professional, and ethical purposes.

By using the Services, you agree to comply with:

• All applicable laws and regulations.
• Professional standards of conduct in the fitness and sports industry.
• Applicable data protection and privacy laws.
• These Terms of Service.

Any use of the platform outside its intended purpose is strictly prohibited.

11. Responsibilities of Personal Trainers

As a Personal Trainer, you agree to:

• Protect the confidentiality of your clients' information.
• Use client data solely for providing professional coaching services.
• Never share client information with unauthorized persons.
• Access client measurements and health information only when necessary for providing services.
• Prepare workout and nutrition programs based on the client's individual needs whenever reasonably possible.
• Keep your account secure and not allow others to use it.
• Refrain from any activity that could compromise the security of the platform.
• Comply with all PTAsistant policies and guidelines.

12. Responsibilities of Studio Trainers

As a Studio Trainer, you additionally agree to:

• Access only the clients assigned to you.
• Operate only within the permissions granted by the Studio Owner.
• Not access client information assigned to other trainers without authorization.
• Not interfere with financial or administrative areas beyond your assigned permissions.
• Maintain the confidentiality of all client and studio information available through your role.

13. Client Data Confidentiality

All client information accessible through PTAsistant is confidential.

This may include:

• Health information.
• Apple Health data.
• Body measurements.
• Progress photos.
• Nutrition records.
• AI-generated analyses.
• Contact information.

You may access this information solely for the purpose of providing professional services to your clients.

Except where required by law or expressly authorized by the client, you may not disclose, copy, transfer, or share client information with any third party.

14. Suspension or Termination of Your Account

DarkLag Software reserves the right to temporarily suspend or permanently terminate your account if you:

• Violate these Terms of Service.
• Engage in unlawful activities.
• Provide false or misleading information.
• Misuse client information.
• Compromise platform security.
• Infringe intellectual property rights.
• Misuse the Services.
• Violate the rights of third parties.

Suspension or termination of an account does not limit any legal rights available to DarkLag Software.

15. Apple Health and Apple Watch

PTAsistant supports Apple Health and Apple Watch integration.

Apple Health integration is entirely optional for clients.

Clients may share Apple Health information with PTAsistant only after granting explicit permission.

As a Personal Trainer or Studio Trainer, you may access only the health and performance information that your client has explicitly chosen to share with you.

Apple Health information may be used only for legitimate coaching purposes, including:

• Workout planning.
• Performance evaluation.
• Recovery analysis.
• Cardiovascular performance monitoring.
• Exercise intensity optimization.
• Tracking client progress.

Any use of Apple Health information beyond these purposes is strictly prohibited.

16. AI Services

PTAsistant includes AI-powered features that may provide:

• Meal analysis.
• Nutrition recommendations.
• Workout recommendations.
• Performance evaluations.
• Progress analyses.
• Sport-specific recommendations.

AI-generated outputs are intended solely as supportive information.

They must not be interpreted as medical diagnoses, treatment recommendations, prescriptions, or definitive scientific conclusions.

As a Personal Trainer or Studio Trainer, you remain solely responsible for your professional decisions and recommendations provided to your clients.

17. AI Meal Analysis

The AI Meal Analysis feature analyzes meal photographs uploaded by clients and generates estimated nutritional information.

Analysis results may include:

• Estimated Calories.
• Protein.
• Carbohydrates.
• Fat.
• Fiber.
• Meal evaluation.
• Nutrition goal compliance.

These analyses are intended solely to support nutrition tracking and coaching.

They are estimates only and must not be considered laboratory analyses or medical evaluations.

18. Use of Client Data

Client information available through PTAsistant is provided solely to enable you to deliver professional coaching services.

This information may include:

• Health records.
• Body measurements.
• Apple Health data.
• Apple Watch workout records.
• Nutrition plans.
• AI-generated analyses.
• Progress photos.
• Appointment history.
• Workout program history.

You may use this information only for monitoring your client's progress and providing professional fitness services.

19. Data Confidentiality Obligations

As a Personal Trainer or Studio Trainer, all client information you access through PTAsistant is confidential.

You agree that you will not:

• Share client information with unauthorized third parties.
• Copy or reproduce client data for unauthorized purposes.
• Use client information for commercial purposes unrelated to PTAsistant.
• Transfer client information to other platforms without the client's explicit consent.
• Provide unauthorized individuals with access to confidential client information.

These confidentiality obligations continue even after your PTAsistant account has been suspended or terminated.

20. User Content

You retain ownership of all content that you create through PTAsistant.

This may include:

• Workout programs.
• Nutrition plans.
• Professional notes.
• Measurement records.
• Progress evaluations.
• Comments and coaching feedback.

DarkLag Software does not claim ownership of your content.

However, you grant DarkLag Software the limited technical rights necessary to securely process, store, display, and deliver such content within PTAsistant and to your authorized clients.

21. Prohibited Uses

PTAsistant may not be used to:

• Engage in unlawful activities.
• Access another person's account without authorization.
• Attempt unauthorized access to systems or data.
• Compromise platform security.
• Upload malware or other malicious software.
• Reverse engineer, decompile, or attempt to extract the source code of the platform.
• Abuse the Services through bots or other automated systems.
• Upload content that infringes intellectual property rights.
• Create or distribute misleading health information.
• Provide deceptive or misleading professional advice to clients.
• Interfere with other users' ability to use the Services.

DarkLag Software reserves the right to suspend or permanently terminate accounts engaged in prohibited activities without prior notice.

22. Intellectual Property

PTAsistant, including but not limited to its:

• Software.
• User interface.
• Designs.
• Logos.
• Images.
• Icons.
• Database structure.
• Artificial intelligence systems.
• Algorithms.

is protected under applicable intellectual property laws.

Without prior written permission from DarkLag Software, PTAsistant and its intellectual property may not be:

• Copied.
• Reproduced.
• Distributed.
• Licensed.
• Sold.
• Used for commercial purposes.

23. Medical Disclaimer

The platform does not replace the services of:

• Physicians.
• Dietitians.
• Physiotherapists.
• Psychologists.
• Other qualified healthcare professionals.

Apple Health information, Apple Watch data, AI-generated analyses, nutrition recommendations, and performance evaluations are provided solely as supportive information.

Personal Trainers and Studio Trainers remain fully responsible for evaluating, modifying, and implementing workout programs, nutrition plans, and other professional recommendations provided to their clients.

24. Service Updates

DarkLag Software continuously works to improve PTAsistant.

Accordingly, we may:

• Introduce new features.
• Update existing functionality.
• Discontinue certain services.
• Modify the user interface.
• Update subscription plans and available features.

These changes are intended to improve the quality of the Services and may be communicated through the application or your registered contact information whenever appropriate.

25. Paid Services and Subscriptions

Certain PTAsistant features are available through paid subscription plans.

Subscription plans may differ based on:

• Available features.
• Client capacity.
• AI usage limits.
• Storage capacity.
• Advanced reporting tools.
• Additional professional services.

Current subscription pricing is clearly displayed before purchase.

DarkLag Software reserves the right to modify subscription plans and pricing in accordance with applicable law.

26. Payment Processing

All in-app purchases and subscription payments for PTAsistant are processed through the Apple App Store or other supported official payment providers.

DarkLag Software:

• Does not store your credit or debit card information.
• Does not have access to your payment credentials.
• Does not directly process payment transactions.

All payment transactions are governed by the terms and privacy policies of the applicable payment provider.

27. Subscription Renewal and Cancellation

Unless otherwise specified, paid subscriptions renew automatically at the end of each subscription period.

You may disable automatic renewal at any time through your Apple ID subscription settings.

If you cancel your subscription, you will continue to have access to purchased features until the current billing period expires.

Unless otherwise required by applicable law or the policies of the relevant app marketplace, refunds are generally not available for partially used subscription periods.

28. Service Availability

DarkLag Software strives to maintain PTAsistant with the highest reasonably achievable level of availability.

However, temporary interruptions may occur due to:

• Third-party service outages.

It is not:

• A healthcare provider.
• A hospital.
• A medical diagnostic system.
• A medical treatment platform.

DarkLag Software shall not be liable for any direct or indirect damages arising from or related to:

• Content created by users.
• Workout programs prepared by Personal Trainers.
• Nutrition plans created by trainers.
• Professional advice provided by trainers.
• Activities performed outside the PTAsistant platform.
• The accuracy or completeness of Apple Health data.
• Services provided by third-party providers.
• The implementation of AI-generated recommendations.

All analyses, reports, and AI-generated recommendations provided by PTAsistant are intended solely as supportive information.

30. User Responsibilities

Subscription fees for Studio Owner accounts are purchased through the application.

All payments are processed through the Apple App Store or other officially supported payment providers.

• Does not access your debit or credit card details.
• Cannot view your payment credentials.

9. Automatic Renewal

Unless otherwise stated, subscriptions may automatically renew at the end of each billing period.

• Management analytics

AI-generated outputs are intended solely as supportive information.

No AI-generated result constitutes medical advice, diagnosis, treatment, or professional healthcare guidance.

A Studio Owner may access only the information associated with their own business organization.

18. Studio Trainer and Personal Trainer Management

As a Studio Owner, you may manage the Studio Trainer and Personal Trainer accounts operating within your business.

• Deactivate accounts
• Manage responsibilities and assignments

A Studio Owner may manage only the accounts created within their own business.

No authority is granted over users belonging to other businesses or organizations.

As a Studio Owner, you may manage members registered within your business.

This includes the ability to:

• Create new member accounts
• Update membership information
• Assign members to Studio Trainers or Personal Trainers
• Manage membership status

However, members' private health records, Apple Health information, and personal health analyses are accessible only to the authorized Personal Trainer responsible for that member and only with the member's explicit consent.

The Studio Owner account is not intended to access members' confidential health information.

20. Authorization System

PTAsistant operates using a comprehensive role-based authorization system.

The Studio Owner account has different permissions from the following account types:
